Bad faith defense is the core of Young | Duke’s practice. We bring a deep bench of dedicated bad faith defense attorneys with extensive experience trying these cases in Florida’s state and federal courts. We counsel and defend insurers in first party and third party bad faith matters, from early claims handling advice through trial of the bad faith case and appeal. Our experience encompasses common law and statutory bad faith claims involving primary and excess carriers, personal and commercial lines, and involving a wide variety of underlying claims including auto accidents, property claims, premises liability, malpractice, admiralty, and construction claims.

Our dedicated team has handled more than 60 bad faith trials in Florida’s state and federal courts. We have achieved defense verdicts in nearly 80% of our bad faith trials, and have prevailed in over 50 cases on dispositive motion. We also have extensive experience defending these trial court wins on appeal in both state and federal courts, obtaining affirmance in the vast majority of cases and creating favorable case law for the insurance industry in the process. These wins have eliminated hundreds of millions of dollars in exposure to our clients.
